1. Definitions
Throughout this document, the following terms carry specific meanings:
- "Timbervale" / "We" / "Us" / "Our" โ refers to the residential care home operating at 156 Corydon Avenue, Winnipeg, MB R3M 0Y1, Canada.
- "Resident" โ any individual who has entered into a residency arrangement with Timbervale.
- "Family Contact" / "Authorised Representative" โ a family member or legally authorised person designated by the Resident to liaise with Timbervale on their behalf.
- "Services" โ the residential, dining, programming, and support offerings described in the Residency Agreement and on our website.
- "Agreement" โ the Residency Agreement signed between the Resident (or their representative) and Timbervale, which incorporates these Terms & Conditions.
- "Website" โ the Timbervale website accessible at https://timbervale.
2. Acceptance of Terms
By signing the Residency Agreement or submitting an enquiry through our website, the Resident or their authorised representative acknowledges having read, understood, and agreed to these Terms & Conditions.
Residency at Timbervale is available to adults aged 18 and older. In practice, our services are designed for seniors who are able to live without on-site medical care. Any person entering an arrangement on behalf of a prospective resident must have the legal capacity to do so.

3. Service Description
Timbervale provides non-medical senior residential boarding in Winnipeg, Manitoba. Our offerings currently include:
- Home-Style Room & Meals โ furnished semi-private room, three daily home-cooked meals, shared living space access, and twice-weekly light housekeeping (CAD $235/month).
- Garden & Nature Connection Program โ a structured seasonal outdoor program with garden plots, birdwatching activities, and indoor winter programming (CAD $340/month).
- Comprehensive Living Arrangement โ a complete private-room package including meals, housekeeping, laundry, garden programming, weekly transportation, and a personal staff liaison (CAD $940/month).
Services are provided within the capacity and character of a residential home. Timbervale does not provide medical, nursing, or personal care services. Residents requiring such support are responsible for arranging these independently.
Service availability is subject to room capacity. We will communicate any significant changes to service scope in writing with reasonable advance notice.
4. Residency Conditions
Residency at Timbervale is offered to individuals who:
- Do not require on-site nursing, medication management, or personal care assistance beyond what is described in the selected service arrangement.
- Are able to participate in community living in a respectful and cooperative manner.
- Provide accurate and complete information during the application process.
Timbervale reserves the right to decline a residency application or to transition a resident to an alternative arrangement if circumstances change materially. We will handle any such situation with sensitivity and provide reasonable transition support.
Residents may personalise their rooms with personal items, photographs, and small furnishings, provided these do not pose a safety concern or damage the property. Structural modifications to rooms are not permitted.
5. Resident Responsibilities
Residents are asked to contribute to a peaceful, respectful home environment. This includes:
- Treating staff and fellow residents with courtesy and consideration.
- Following reasonable household guidelines communicated by Timbervale staff.
- Keeping personal living spaces in a reasonable state of tidiness between housekeeping visits.
- Informing staff of any concerns about their wellbeing or safety promptly.
- Refraining from behaviour that disrupts the comfort of others in the residence.
- Notifying Timbervale of any planned extended absences of three or more consecutive days.
The following are not permitted within the residence or on its grounds:
- Behaviour that endangers the safety of others.
- Smoking indoors or in areas not designated for this purpose.
- Keeping pets without prior written consent from Timbervale management.
- Operating a commercial or business activity from within the residence.
- Subletting or sharing the room with a third party not included in the residency arrangement.
6. Payment Terms
All fees are quoted and charged in Canadian dollars (CAD). Monthly residency fees are due on the first day of each calendar month. Payment methods accepted include cheque, electronic funds transfer (EFT), and other methods agreed upon in writing.
A security deposit equivalent to one month's fee is collected prior to move-in and held in trust. It is returned within 30 days of departure, less any amounts owing for unpaid fees or documented damage beyond normal wear and tear.
Late Payments: Fees unpaid beyond ten calendar days of the due date may attract a late fee as outlined in the Residency Agreement. Timbervale will endeavour to discuss payment challenges with residents or their representatives before applying any such fees.
Fee Changes: Timbervale may adjust monthly fees with a minimum of 60 days written notice. Any increase will be clearly communicated and applied only at the start of a new billing month.
Refunds: Monthly fees are not refunded for partial months upon departure unless the departure results from a circumstance outside the resident's control. Refund requests are reviewed on a case-by-case basis with care and fairness.
7. Intellectual Property
All content on the Timbervale website โ including text, imagery, graphics, and design elements โ is the property of Timbervale and is protected by applicable Canadian intellectual property laws.
Visitors and enquirers are welcome to use the website for personal, non-commercial purposes. Reproducing, distributing, or modifying website content for commercial purposes without written permission is not permitted.
Any feedback, suggestions, or ideas submitted to Timbervale may be used by us to improve our services without obligation or compensation.
8. Disclaimers
Timbervale operates as a residential boarding home, not a licensed long-term care facility, nursing home, or retirement complex with on-site medical services. Our services are designed to support comfortable, social, and structured independent living for seniors.
We do not make claims about health outcomes, medical progress, or personal care results. Residents and their families are encouraged to maintain relationships with their own healthcare providers for all medical needs.
Website information is provided in good faith and kept as current as reasonably possible. It does not constitute professional medical, legal, or financial advice.
Timbervale is not responsible for the content of external websites that may be linked from our pages.
9. Limitation of Liability
To the extent permitted by applicable Manitoba and Canadian law, Timbervale's liability for any claim arising from these terms or the services provided shall be limited to the total fees paid by the resident in the three months preceding the event giving rise to the claim.
Timbervale shall not be liable for indirect, incidental, or consequential losses, including loss of personal property unless caused by demonstrated negligence on our part.
Residents are responsible for their own valuables and are encouraged to maintain personal property insurance. Timbervale is not liable for loss or damage to personal items that are not caused directly by our negligence.
Nothing in these Terms limits liability for personal injury caused by Timbervale's negligence, fraud, or any liability that cannot be excluded under applicable Canadian consumer protection law.
10. Termination
By the Resident: A resident wishing to end their arrangement should provide at least 30 days written notice. We will work cooperatively to support a smooth and dignified transition.
By Timbervale: We reserve the right to end a residency arrangement in circumstances where the resident's behaviour poses a risk to the safety or wellbeing of others, where the resident's care needs fall beyond the scope of our services, or where material terms of the agreement have been repeatedly and knowingly breached. In non-urgent situations, we will provide at least 30 days notice and offer reasonable transition assistance.
Immediate Termination: In the event of a serious safety concern, Timbervale may end an arrangement immediately and will coordinate with the resident's family contact and, where necessary, relevant Manitoba authorities.
Upon termination, any amounts owing become immediately payable. The security deposit will be reconciled and returned in accordance with Section 6.
11. Dispute Resolution
These Terms & Conditions are governed by the laws of the Province of Manitoba and the applicable laws of Canada. Any disputes will be subject to the jurisdiction of the courts of Manitoba.
We encourage open and respectful dialogue as the first step in resolving any disagreement. Residents or their representatives are welcome to raise concerns with Timbervale management directly. We commit to responding to written concerns within five business days.
Where informal resolution is not achievable, either party may seek mediation through a mutually agreed mediator before pursuing formal legal proceedings. This step is voluntary but encouraged.
Residents also have the right to raise concerns with the Manitoba Ombudsman or relevant provincial consumer protection authority where applicable.
12. General Provisions
Entire Agreement: These Terms & Conditions, together with the signed Residency Agreement, constitute the complete agreement between the parties with respect to the subject matter herein.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
Waiver: Failure by Timbervale to enforce any provision of these Terms on a given occasion does not constitute a waiver of the right to enforce that provision in the future.
Assignment: Residents may not transfer or assign their residency arrangement to another person. Timbervale may transfer or assign its obligations to a successor entity in the event of a change in ownership, with appropriate notice to residents.
Notices: Formal written notices may be delivered by hand, post, or email to the addresses provided in the Residency Agreement. Email notice is considered delivered when sent to the address on file.
13. Changes to These Terms
Timbervale may update these Terms & Conditions from time to time. Where changes are material, current residents will be notified in writing at least 30 days in advance of the effective date.
The updated document will be posted on our website with a revised "Last Updated" date. Continued residency after the effective date of any changes constitutes acceptance of the revised terms.
We are always open to discussing any changes with residents or their family contacts before they take effect.
